Privacy Policy Daniel Gelb Law (“DGL”)

The following is the privacy policy (the “Privacy Policy”) of DGL. This Privacy Policy confirms our dedication to protecting personal information in our possession.
A. AN OVERVIEW
1. WHAT THIS POLICY COVERS
This Policy covers how DGL treats the personal information contained in files provided to us.
Personal information is defined as:

opinions, evaluations, comments, social status, or disciplinary actions; and

2. PURPOSES FOR COLLECTION OF PERSONAL INFORMATION
DGL collects personal information for the following limited purposes:
(a) to provide services;
(b) to correspond with individuals as part of providing services including authorized representatives, third parties, witnesses, or experts;
(c) to administer or bill; and
(d) to provide to sub-contractors if necessary to provide services, correspond, administer or bill or any other aspect listed above.
3. HOW PERSONAL INFORMATION IS USED
DGL may contact the client, witnesses, experts or any individual on file or whose personal information is provided by you or whose personal information is obtained as a result of investigation, directly at any point during the process of providing legal services to you, in order to assist you in representing the client on file.
4. HOW PERSONAL INFORMATION IS MAINTAINED
DGL storage and maintenance of personal information conforms to the Personal Information Protection and Electronic Documents Act (the “Act”) and the Model Code for the Protection of Personal Information (the “Code”) requirements.
B. APPLICATION OF THE CODE
DGL applies the ten principles of the Code as follows:
1. ACCOUNTABILITY
DGL has designated an individual to be responsible for the personal information collected and maintained by it. Procedures have been developed to protect personal information, members of DGL have been trained and information about our policies and procedures are distributed to the public by posting this information on DanielGelbLaw.com.
2. IDENTIFYING PURPOSES

3. CONSENT
DGL is committed to ensuring you know the nature, purpose and consequences of our collection of personal information. It is important that we obtain a valid informed consent to the use of personal information. To obtain this consent, we provide information about how personal information is used. We may request further written confirmation at any time.

4. LIMITING COLLECTION
DGL collects personal information in a fair and lawful manner only for the purposes identified including to provide services or pursuant to the above noted reasons.
5. LIMITING USE, DISCLOSURE AND RETENTION
DGL does not use personal information for purposes other than those for which it was collected, except with the express consent of the individual or as required by law.
Personal information that is no longer required to fulfill the identified purposes will be destroyed, erased or made anonymous. DGL will retain only such information that is necessary to comply with legal and Law Society record keeping requirements.
6. ACCURACY
DGL is committed to maintaining accurate, complete and up-to-date personal information. You can update your personal information by contacting us by telephone using the number on our website.
7. SAFEGUARDS
DGL developed and implemented security safeguards to protect personal information against loss or theft, unauthorized access, disclosure, copying, use or modification. All staff is trained regarding the importance of maintaining the confidentiality of personal information. We destroy or dispose of personal information that is no longer needed to prevent unauthorized access.
PROTECTION OF INFORMATION INCLUDES:
(a) organizational measures limiting access to a “need-to-know” basis;
(b) premises security; and
(b) technological measures, including the use of passwords and encryption.
8. OPENNESS
DGL policies and practices respecting the collection and maintenance of personal information are available to individuals. 9. INDIVIDUAL ACCESS
Individuals can request access to their personal information held by us. However, your identity must be confirmed by us prior to the release of any information. Requests in writing should be forwarded to info[at] DanielGelbLaw.com
Your rights to access your personal information are not absolute under s.9 of the Act. Examples where access can be denied include but are not limited to:
• if doing so would likely reveal personal information about a third party and the information about the third party is not severable;
• an individual’s life health, or security is threatened;
• the information is protected by solicitor-client privilege;
• doing so would reveal confidential commercial information;
• doing so could reasonably be expected to threaten the life or security of another individual; or
• the information was generated during a formal dispute resolution process.

10. CHALLENGING COMPLIANCE

I or a staff person designated by me, who is responsible for the day-to-day care and control of personal information, will receive and respond to all complaints in a timely manner. If any complaint is found to be justified, then we will take appropriate measures to resolve the matter.

Our website contains links to other sites, which are not governed by this privacy policy. On our website, like most other commercial websites, we may monitor traffic patterns, site usage and related site information in order to optimize our web service. We may provide aggregated information to third parties, but these statistics do not include any identifiable personal information.

Employment Inquiries
If you apply to DanielGelbLaw.com for a job, we need to consider your personal information, as part of our review process. We normally retain information from candidates after a decision has been made, unless you ask us not to retain the information. If we offer you a job, which you accept, the information will be retained in accordance with our privacy procedures for contract employee records.
